Legal Framework for Arrest Records

Public Records Law

Under Alabama Code Section 36-12-40, you have the right to look at and copy public records. Arrest records, booking info, and court records are mostly public in Alabama. The jailer's logbook counts as a public record. Anyone can ask to see it.

What Information Is Public

Public arrest records include the inmate's name, date of birth, and booking date. You can also see charges, bond amount, court dates, case outcomes, and mugshots. But some things stay private. Social Security numbers and driver's license numbers are kept back to stop identity theft.

Records Not Available to the Public

Some arrest records are off limits. Juvenile records are private under state law. You can't access them. Sealed and expunged records are blocked too. Active cases and open warrants stay hidden. That protects police work and keeps officers safe.

Expungement in Randolph County

Alabama law lets you expunge some arrest records. You might qualify if charges got dropped. Or if you were found not guilty at trial. Finishing a pretrial diversion program can help too. Some non-violent convictions can be cleared after a wait. To start, file a petition with the Randolph County Circuit Court. It costs $500 unless the court gives you a waiver for low income. Then you go to a hearing. The judge decides if you get the expungement. Call (256) 357-4551 for forms.
